Hanoi (VNA) – Vietnam's Ministry of Industry and Trade said the US Department of Commerce (DOC) rescinded the second Period of Administrative Review (POR2) of the anti-dumping tariff order on wind towers of Vietnam.
According to the US Federal Register (Vol. 81 No. 204) issued on October 21, the DOC is rescinding its administrative review of utility scale wind towers from Vietnam for the period from February 1, 2015 through January 31, 2016, based on the withdrawal of request for review.
On February 3, 2016, the department published the notice of opportunity to request an administrative review of the antidumping duty order on wind towers from Vietnam for the above POR.
On February 23, 2016 and February 29, 2016, the department received a timely request from the Wind Tower Trade Coalition (petitioner) and CS Wind Vietnam Co., Ltd. (CS Wind), respectively, to conduct an administrative review.
Pursuant to these requests and existing laws, on April 7, 2016, the DOC published a notice of initiation of an administrative review of the antidumping duty order on wind towers from Vietnam. However, on July 6, 2016, the petitioner and CS Wind withdrew their requests for an administrative review.
Pursuant to existing US regulations, the department would rescind an administrative review, in whole or in part, if the party that requested the review withdraws the request within 90 days of the publication date of the notice of initiation of review.
The department would instruct US Customs and Border Protection (CBP) to assess anti-dumping duties on all appropriate entries of wind towers from Vietnam.
Anti-dumping duties shall be assessed at rates equal to the cash deposit of estimated antidumping duties required at the time of entry, or withdrawal from warehouse, for consumption in accordance with existing US regulations. The department intended to issue appropriate assessment instructions to CBP 15 days after the date of publication of this notice of rescission of administrative review.
According to the DOC's final results of the first Period of Administrative Review (POR 1) with anti-dumping tariffs imposed on Vietnamese wind towers released on September 2015, the only compulsory defendant, CS Wind Vietnam, did not sell its wind towers in the United States at unfairly low prices, the Vietnam Competition Authority under the Ministry of Industry and Trade said.
However, the United States still decided to keep imposing an anti-dumping duty margin of 58.54 percent on wind towers exported by other companies in Vietnam as it still considers Vietnam a non-market economy.
The US is determined to slap anti-dumping tariff following a probe into wind towers imported from Vietnam in late 2012.-VNA
