Trade ministry gears up for first steel review

The Trade Remedies Authority of Vietnam has started receiving dossiers for the first review of anti-dumping duties on some H-shaped steel products imported from China.

Hanoi (VNS/VNA) – The Trade Remedies Authority of Vietnam under theMinistry of Industry and Trade (MoIT), has started receiving dossiers for thefirst review of anti-dumping duties on some H-shaped steel products importedfrom China.

The dossiers must be completed and submitted directly to the investigatingagency before 5pm on August 21, 2018, at 25 Ngo Quyen street, Hoan Kiem district,Hanoi.

On August 21, 2017, the ministry promulgated Decision 3283/QĐ-BCT on imposinganti-dumping duties on H-shaped steel products imported from China with HS codeof 7216.33.00, 7228.70.10 and 7228.70.90. 

According to Article 82 of Law No. 05/2017/QH14 on the management of foreigntrade operations, after one year from the date of issue of the decision onimposition of anti-dumping measures, the MoIT may decide to review the measuresat the request of one or multiple interested parties and the evidence providedby them.

Article 58 of Decree 10/2018/NĐ-CP stimulates that within 60days prior to the end of one year from the date of issuance of the decisionon the imposition of official anti-dumping and countervailing measures or thelatest decision on the results of the review of anti-dumping and countervailingmeasures, the concerned parties may submit the dossiers for review, except incases where the submission deadline is less than nine months before the timelimit for the MoIT to decide whether to carry out the final review ofanti-dumping or countervailing measures.

Therefore, concerned parties have the right to file a request for a reviewunder the guidelines. The scope of the proposed review includes, but is notlimited to, the following: scope of goods subject to anti-dumping measures, thedumping margin applicable to one or more foreign enterprises and the injury ofthe domestic industry.

At the end of the review period, based on the findings of the investigation, theTrade Remedies Authority will propose to the MoIT one of the followingoptions: continue applying anti-dumping measures in accordance with the currentregulations; adjust anti-dumping measures in line with the results of thereview; or terminate the application of anti-dumping measures.

The implementation of procedures related to the review process will not impedethe effective application of anti-dumping measures.-VNS/VNA
