Revised bidding law prioritises local contractors

Le Van Tang, head of the Ministry of Planning andInvestment's Bidding Management Department, said that the revisedbidding law also helped improve the efficiency of State capitalspending.

The revised law encourages community supervision in theselection of bids and contract practices. Individual responsibility andcorresponding punishments for particular improper bidding activities isregulated. These regulations are made to avoid the consequences ofclosed-bids.

There is also a separate part on the bidding processfor medicines and medical equipment purchases that spend State capital,medical insurance funds, healthcare services incomes, and other legalsources of public clinics.

The current law also amends someregulations related to contract management in order to improveresponsibilities of bidders and contractors. These regulations aim ateasing practices of contracts that do not suit the nature of the bidsand that may cause waste.

The selection of investors in thePublic-Private Partnership projects and online procurement are alsopresented in separate chapters.

The objective of the onlineprocurement is to ensure information disclosure and to simplify biddingprocedures. This is in line with the country's commitment to fightcorruption and increase the effectiveness, efficiency and transparencyof public procurement systems.

The revised law also introducesseveral options to evaluate the bidding dossiers for the biddingorganisers to select, particularly the packages on constancy andconstruction work.

And finally, under the new legislation, allforeign bidders are welcome to take part in international bidding inVietnam. However, it is required that foreign contractors work inpartnership with a Vietnamese company or sign a sub-contract with alocal company.

Further, foreign contractors are only allowed toemploy foreign workers when there are no qualified Vietnamese workersavailable for projects.

Also, the new law devotes a chapter one-procurement and legislative requirements on information disclosure, aswell as transparency throughout the procurement process and projectimplementation.

The law also deals with the imposition ofsanctions on violations or acts of prohibition. Any organisation orindividual violating the law will be exposed in the mass media.-VNA
